Terms of Service - CivicBubble™

1. Agreement to Terms

By accessing or using the Civic Bubble website (civicbubble.com), mobile application, widgets, portals, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Services. If you are accessing the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. About the Service

Civic Bubble is an independent, non-partisan platform operated by CivicBubble Inc., a Georgia corporation. The platform compiles publicly available government information, user-generated content, and civic data to provide tools and information for civic engagement. Civic Bubble is not affiliated with, endorsed by, authorized by, or operated by any federal, state, county, or municipal government entity.

3. Types of Users

The Services are used by several types of users:

Individual Users — Individuals who access the Civic Bubble app or website for personal civic information and engagement.

Business Customers — Organizations, campaigns, civic groups, media outlets, and other entities that purchase access to Civic Bubble's platform, portals, widgets, analytics, data reports, or other paid services under a separate Master Software-as-a-Service Agreement ("SaaS Agreement") and Order Form.

Managed Profile Holders — Verified account holders (such as elected officials or candidates) who access the portal and publish content through managed profiles under a separate agreement with CivicBubble Inc.

Widget Viewers — Individuals who view Civic Bubble data through widgets embedded on third-party websites.

If you are a Business Customer, your use of the Services is governed by your SaaS Agreement and Order Form, which take precedence over these Terms in the event of a conflict. These Terms apply to all users to the extent not superseded by a separate written agreement.

4. Use License

CivicBubble Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial civic engagement purposes, subject to these Terms. This license does not include:

modifying, copying, or creating derivative works from the Services or any content;
commercial use, redistribution, or public display of Civic Bubble content without prior written consent;
decompiling, reverse engineering, or disassembling any part of the Services;
removing any copyright, trademark, or proprietary notices;
using automated tools to scrape, harvest, or collect data from the Services;
sublicensing, reselling, or making the Services available to third parties.

This license terminates automatically upon violation of these Terms or at CivicBubble Inc.'s discretion. Business Customers' and Managed Profile Holders' license rights are governed by their respective SaaS Agreements.

5. User Accounts

Some features require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information during registration and promptly update it if it changes. You must notify Civic Bubble immediately of any unauthorized use of your account.

6. Managed Profiles and User Content

Verified account holders who publish content through managed profiles do so under a separate agreement with CivicBubble Inc. that governs portal access and content management. By publishing content, you represent that: (a) you have the right to publish the content; (b) the content is accurate and not misleading; (c) the content does not violate applicable laws or third-party rights; and (d) the content does not contain false, defamatory, or fraudulent information.

You retain ownership of content you publish. By publishing content through the Services, you grant CivicBubble Inc. a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your content through the Services. CivicBubble Inc. reserves the right to remove any content that violates these Terms.

7. Campaign Pages

Civic Bubble offers paid campaign pages that provide candidates with an enhanced presence on the platform, linked from the applicable contest page. Campaign pages are supplemental to the system-generated candidate profiles that Civic Bubble creates from publicly available qualifying and filing data.

System-generated candidate profiles are created using publicly available data and are maintained by CivicBubble Inc. The purchase of a campaign page does not grant any control over or right to modify the system-generated profile. CivicBubble Inc. reserves the right to display publicly available qualifying, filing, ethics, and campaign finance data for all candidates regardless of whether they purchase a campaign page.

Campaign page customers are solely responsible for: (a) the accuracy and legality of content published on their campaign page; (b) all legally required disclaimers, disclosures, and "paid for by" statements; and (c) compliance with all applicable campaign finance and election laws.

CivicBubble Inc. reserves the right to suspend or remove a campaign page, or any content thereon, that violates these Terms, applicable law, or that CivicBubble Inc. reasonably determines to be false, misleading, defamatory, or harmful. Such action shall not affect the system-generated candidate profile.

8. Widgets and Embedded Content

Civic Bubble provides embeddable widgets that display civic data on third-party websites and applications. Widgets are provided under license and remain the property of CivicBubble Inc. Widget publishers shall not modify, rebrand, or alter widgets without prior written consent. Widget publishers are responsible for ensuring that their use of widgets complies with applicable laws and these Terms.

When you view Civic Bubble data through a widget on a third-party website, your interaction with the widget is subject to these Terms and our Privacy Policy, in addition to the third-party website's own terms and privacy policy.

9. Acceptable Use

You shall not use the Services to:

violate any applicable federal, state, or local law or regulation;
transmit content that is unlawful, defamatory, obscene, fraudulent, or harmful;
impersonate any person or entity or misrepresent an affiliation;
transmit viruses, malware, or other harmful code;
interfere with or disrupt the Services or related infrastructure;
scrape, harvest, or collect data from the Services without authorization;
engage in voter suppression, voter intimidation, or any activity that interferes with the lawful exercise of voting rights;
harass, threaten, or intimidate any individual;
publish or distribute false or misleading information about candidates, elections, voting procedures, or government actions;
use data obtained through the Services for commercial solicitation, advertising, or purposes unrelated to civic engagement;
distribute, sell, or share voter data or civic data obtained through the Services to unauthorized third parties;
gain unauthorized access to the Services or related systems;
use the Services in any manner that could damage, disable, or impair the Services.

CivicBubble Inc. reserves the right to suspend or terminate access for any material violation of this section.

10. Non-Partisan Policy

Civic Bubble is a non-partisan platform. CivicBubble Inc. does not endorse or oppose any political party, candidate, or ballot measure. Content published by managed profile holders and campaign page customers reflects the views of those account holders, not the views of CivicBubble Inc.

11. Intellectual Property

The Civic Bubble name, logo, branding, design, layout, software, and original content are the property of CivicBubble Inc. and are protected by applicable intellectual property laws. Government data sourced from public records is not owned by CivicBubble Inc., but the selection, coordination, arrangement, organization, presentation, analysis, and enrichment of such data constitutes a protectable compilation and is proprietary to CivicBubble Inc. Additionally, CivicBubble Inc. independently creates and maintains proprietary data, including but not limited to mappings of officials to offices and organizations, historical records of office holders and past offices held, relationships between government entities, and records derived from monitoring government websites and press releases. This proprietary data is the exclusive intellectual property of CivicBubble Inc. regardless of whether the underlying source information is publicly available.

Copyright Complaints. If you believe that content on the Services infringes your copyright, please contact us at info@civicbubble.com with: (a) a description of the copyrighted work; (b) the location of the allegedly infringing content on the Services; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner; and (e) a statement under penalty of perjury that your notice is accurate and you are the copyright owner or authorized to act on the owner's behalf.

12. Data Accuracy and Sources

The Services may include data sourced from publicly available government records, including but not limited to election data, candidate information, elected official data, campaign finance filings, legislative records, and district boundary information. CivicBubble Inc. uses commercially reasonable efforts to ensure the accuracy and timeliness of such data, but does not guarantee the completeness, accuracy, timeliness, or reliability of any government-sourced data.

Government data may be updated, corrected, amended, or withdrawn by the originating source at any time. Civic data is inherently point-in-time and subject to change. You are responsible for independently verifying any data upon which you intend to rely for material decisions. Information provided through the Services is for general civic engagement and informational purposes only. Civic Bubble does not provide legal, financial, or professional advice. You should verify important information directly with the applicable government source.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. CIVICBUBBLE INC. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVICBUBBLE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CIVICBUBBLE INC. SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING FROM INACCURACIES, ERRORS, OMISSIONS, OR DELAYS IN ANY GOVERNMENT-SOURCED OR PUBLICLY AVAILABLE DATA PROVIDED THROUGH THE SERVICES, INCLUDING ANY DECISIONS MADE OR ACTIONS TAKEN IN RELIANCE ON SUCH DATA.

15. Indemnification

You agree to indemnify, defend, and hold harmless CivicBubble Inc. and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services in violation of these Terms; (b) content you publish through the Services; (c) your violation of applicable law; or (d) your infringement of any third-party rights.

16. Direct Download Disclaimer

When downloading APK files directly from Civic Bubble's website outside of official app stores, you assume all risks associated with sideloading, acknowledge that CivicBubble Inc. bears no responsibility for installation issues, must verify file integrity independently, and accept the software "as is" without additional warranties.

17. Third-Party Links

The Services may contain links to third-party websites and resources. CivicBubble Inc. is not responsible for the content, privacy practices, or availability of linked third-party websites. Inclusion of a link does not imply endorsement.

18. Changes to Terms

CivicBubble Inc. may update these Terms at any time. Changes will be reflected in the "Last updated" date above. Significant changes may be communicated through the app or website. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Cobb County, Georgia, and you consent to the personal jurisdiction and venue of such courts.

20. Age Requirement

The Services are designed for users 18 years of age and older and primarily serve voters and civic participants.

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
